Information on the Processing of Personal Data by Viola

This document is intended to provide users of the web application and service providers (hereinafter also referred to as “you” or the “Data Subject”) with detailed information on how Viola Technology s.r.o., Company ID No.: 21991561, with its registered office at Antala Staška 1565/30, Krč, 140 00 Prague (hereinafter “Viola”), as the controller of personal data, processes your personal data in connection with the operation of the web application at www.violacare.eu. You will also find information here about your rights related to the processing of personal data.

1. What personal data Viola processes

In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation; hereinafter “GDPR”), and in accordance with the relevant national personal data protection legislation, Viola processes the following personal data:

  • IIdentification data: for example, your first name, last name, company name, date of birth, personal identification number.

  • Contact details: for example, email address, phone number, correspondence address.

  • Payment and tax data: for example, first and last name or company name, permanent residence address or registered office, place and date of birth, tax identification number, bank account number, account holder, price of the agreed services.

  • Data regarding the requested service: for example, the location where the Data Subject (user) requests the service, information about health condition, the type of property where the service is provided, specification of the requested services, price, and any other data that the Data Subject provides as part of an inquiry or order.

  • Data regarding the offered service: for example, the location where the Data Subject (provider) offers the service, their experience, photographs, information about additional services, price, copies of identity documents, copies of criminal record extracts, licences, certificates, and other information related to the provision of services.

  • Communication content: for example, the content of contact forms, emails, phone calls, chat messages, and other forms of communication between you and Viola.

  • Automatically collected data: for example, your IP address, browser type and version, operating system, location data, information about website usage, visited pages, search terms, and cookies.

Viola processes personal data solely for the purposes set out below, only to the extent necessary, and only for as long as necessary to achieve those purposes.

2. Purposes and legal bases for the processing of personal data

Viola processes your data for the following purposes:

  • Performance of contractual obligations and provision of services: Identification, contact, payment, tax, and other relevant data are processed for the purpose of concluding and performing a contract, providing services through the web application, and facilitating contact between users and providers. The legal basis is the performance of a contract or taking steps prior to entering into a contract. The data are retained for the duration of the contractual relationship and for 5 years after its termination.

  • Facilitating communication between users and independent providers: In order to ensure effective communication between users and service providers, Viola processes the necessary data. The legal basis for this processing is the performance of a contract between the Data Subject and Viola, or Viola’s legitimate interest in facilitating communication. The data are retained for at least 5 years from the date of collection.

  • Protection of legal claims and defence of rights: Viola may process personal data to the extent necessary to exercise its rights, recover claims, or defend itself against claims by third parties. The legal basis for this processing is Viola’s legitimate interest in protecting its rights. The data are retained for the period prescribed by law, usually 10 years from the end of the contract or cooperation, or longer in the event of a dispute.

  • Marketing and commercial communications: Contact details, in particular email addresses, are used to send commercial communications and promote Viola and the services of the web application. The legal basis is legitimate interest or consent. You may unsubscribe from such communications at any time. The data are retained for a maximum of 5 years from the last communication.

  • Compliance with legal obligations (for example, tax agenda, DAC7 Directive): Viola is required by law to process certain data. The processing of personal data, including identification data, contact data, and payment and tax data, is necessary for reporting the required information in accordance with tax regulations (in particular the DAC7 Directive). The legal basis is compliance with Viola’s legal obligation. The retention period is determined by legal regulations.

  • Measures against illegal content (Digital Services Act): Viola processes personal data for the purpose of enabling the reporting and removal of illegal content, or for providing information to administrative authorities. For this purpose, Viola processes identification data, contact data, payment and tax data, data regarding the requested service, data related to the offered service (including copies of identity documents, authorisations/licences, and other documents related to the provision of Professional Assistance), and data contained in submitted communications. The legal basis is compliance with a legal obligation or the performance of a task carried out in the public interest. The data are retained for the period required by law.

  • Promotion and marketing with your consent: With your consent, Viola may use, for example, your photographs for marketing purposes on the website, social media, or in promotional materials. The data are processed until consent is withdrawn, but for no longer than 10 years from publication.

  • Ensuring website operation and security: Automatically collected information (necessary cookies) is processed to ensure the proper functioning and security of the website. The legal basis is legitimate interest. The data are retained for no longer than 1 year.

  • Statistical and analytical purposes: With your consent, Viola analyses website traffic and usage in order to improve its services. The data are processed until consent is withdrawn, but for no longer than 1 year from the last visit. The legal basis for processing is the consent of the Data Subject granted through the cookie information banner.

  • Advertising personalisation: Viola also processes personal data for the purpose of obtaining information about personal preferences and for displaying and targeting relevant advertising. For this purpose, Viola processes automatically collected information (marketing cookies) based on the Data Subject’s consent. In this context, personal data may be transferred to third parties. The data are processed until consent is withdrawn, but for no longer than 1 year from the last visit. The legal basis for this processing is therefore the Data Subject’s consent granted through the cookie information banner.

3. Who may have access to your data

Viola selects its contractual partners, who may act as personal data processors, with the utmost care. Personal data are disclosed only to those entities that ensure they have adopted and maintain adequate technical and organisational measures. These measures are intended to protect personal data against any unauthorised access, disclosure, alteration, loss, or destruction, whether accidental or resulting from unlawful conduct. Viola therefore ensures that the security of your data is maintained during every stage of processing and transfer to third parties.

 

In addition to Viola and its employees, personal data may be made accessible to the following categories of recipients:

  • Viola’s contractual partners or persons who assist with website operation, technical support, marketing, legal, or tax advisory services.

  • Collaborating persons and partners who cooperate with Viola on the basis of cooperation agreements or similar arrangements and participate in the administration of the platform and the provision of Viola services.

  • Persons or companies that directly provide services ordered by Data Subjects.

  • Providers of IT systems, software, communication, and marketing tools (for example Google, Meta, Microsoft, Slack, WhatsApp, Wix).

  • Companies that provide SMS distribution services for Viola.

  • The public, if certain data (for example photographs or references) are published on the website or social media.

  • External entities providing legal, tax, or other professional advisory services to Viola, such as law firms or tax advisors.

  • Public authorities, courts, and other institutions, if required by law or in the context of legal proceedings..

  • Where data are transferred to third countries outside the EEA, Viola ensures an adequate level of protection, for example through European Commission decisions or standard contractual clauses.

4. Your rights

As a Data Subject, you have the following rights in relation to the processing of your personal data:

  • Withdraw consent: If the processing is based on your consent, you may withdraw it at any time.

  • Access: You have the right to know whether Viola processes your personal data and, if so, which data.

  • Data portability: You may request that your data be transferred to another controller in a commonly used format, or that they be transmitted directly where technically feasible.

  • Rectification: If any data are inaccurate or outdated, you may request their correction.

  • Restriction of processing: In certain cases, you may request that Viola restrict the processing of your data.

  • Erasure: If the data are no longer needed or have been processed unlawfully, you have the right to request their deletion.

  • Objection: If Viola processes data and such processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller, or if the processing is necessary for the purposes of the legitimate interests of the controller or a third party, you may object to such processing.

  • Complaint: If you believe that your rights have been violated, you may lodge a complaint with the Personal Data Protection Office.
